These Terms of Use (the "Terms") set out the conditions for using the training log app Totem Lift (the "App") provided by Lightforce.tech ("we", "us" or "our"). Users of the App ("you") use the App on the basis that they agree to these Terms, and are deemed to have agreed to them when they sign in to the App.
Article 1 (Application)
1. These Terms apply to every relationship between you and us concerning the use of the App.
2. The Privacy Policy and any other individual rules we post in the App or on our website form part of these Terms. Where these Terms conflict with an individual rule, the individual rule prevails.
Article 2 (The App)
1. The App is an application that helps you keep records of strength training and similar exercise.
2. The following features are free.
- (1) Logging training, searching for exercises, and viewing progress graphs (the records you can view are those from the most recent year)
- (2) Syncing to the cloud (on one device at a time), and restoring your history on a new device
- (3) Exporting your records in CSV format (covering your records for the whole period)
- (4) AI features using your own API key
3. The following features are available with a subscription under the next Article.
- (1) Trainee plan: using the App on several devices at once, viewing records more than one year old, sharing records with friends, and analysis by the AI we provide
- (2) Trainer plan: every feature of the trainee plan, plus features for managing the accompaniment of clients
4. Even without a subscription, records more than one year old are kept, not deleted, and become viewable from the moment you subscribe.
Article 3 (Subscriptions)
1. Subscriptions are purchased through in-app purchase on the App Store. Purchases, automatic renewals, cancellations and refunds are processed as transactions between you and Apple Inc., in accordance with Apple Inc.'s rules.
2. Prices, renewal dates and whether a free trial is offered for each plan are as shown on the App Store at the time of purchase.
3. We do not receive your credit card information, and do not issue refunds to you directly.
4. Cancelling a subscription does not delete your training records. After cancellation, however, you can no longer view records older than the most recent year. Even then, the records are kept, and you can still export them in CSV format.
5. We use the service of RevenueCat, Inc. to confirm purchases and manage their validity periods.
6. In-app purchases in the App are still being prepared, and no charges are currently made.
Article 4 (Account)
1. You sign in to the App with Sign in with Apple.
2. You are responsible for managing your account and your devices, and must not let any third party use your account.
3. We treat any operation performed with your account as an operation performed by you.
4. People under 13 may not use the App. Minors must obtain the consent of a parent or other legal guardian before using the App. In addition, where the law of the country you live in sets an age below which a legal guardian's consent is needed for the handling of personal information (in member states of the European Union, an age each state sets between 13 and 16; in the United Kingdom, 13), a user under that age may use the App only with the consent of a legal guardian.
5. If a minor uses the App by deception, such as falsely claiming to have the legal guardian's consent or to be an adult, the minor may not rescind any legal act relating to the use of the App.
6. If a user who was a minor when agreeing to these Terms uses the App after reaching the age of majority, the user is deemed to have ratified the legal acts relating to the use of the App made while a minor.
Article 5 (Training Records)
1. The rights in the information you enter in the App ("your data") belong to you.
2. You permit us to use your data free of charge (including copying, storing, processing and transmitting it) to the extent needed for us to provide the App.
3. We do not guarantee the accuracy of your data. If the same record is changed on more than one device, the version saved last is kept.
4. We endeavour to keep your data, but do not guarantee that it will not be lost, or that lost data can be recovered.
Article 6 (Sharing with Other Users)
1. Sharing records with friends and accompaniment by a trainer are features you start yourself, choosing whom to share with and how much. The scope of what is shared is as set out in the Privacy Policy.
2. If you allow a trainer to log on your behalf, that trainer can enter training records in your account for dates within one day before or after the day of the session. Such entries are treated as acts you have authorised.
3. You can stop sharing at any time. After you do, we no longer show new information to the other person.
4. We cannot prevent the people you share with from saving or copying, by other means, information shown on their screens. Please share only with people you trust.
Article 7 (AI Features)
1. To use the AI features, you must consent to "sending records to third parties" as described in the Privacy Policy.
2. If you use services from OpenAI, Google or Anthropic with your own API key, you are responsible for paying for those services and for complying with their terms of use. You must manage your API key carefully so that it is not leaked.
Article 8 (External Services)
Your use of services from Apple and other third parties that work with the App is governed by your agreements with those third parties. We do not guarantee the content or continuity of those services, or the accuracy of information obtained from them.
Article 9 (Information Recorded by Trainers)
1. Information that users of the trainer plan register about their clients can be viewed only by that trainer, and is not shown to other users, including the client.
2. A trainer who registers information about another person is responsible for handling that information properly.
Article 10 (Prohibited Conduct)
1. When using the App, you must not do any of the following.
- (1) Act in breach of the law or of public order and morals

- (8) Any other act equivalent to those above
2. If you breach the preceding paragraph and cause damage to us or a third party, you must compensate for that damage.

Article 13 (Intellectual Property)
1. Copyright and other intellectual property rights in the App belong to us or to their rightful holders.
2. On condition that you follow these Terms, we grant you a non-exclusive right to use the App for personal purposes. You must not copy, modify or redistribute the App, or circumvent its technical protection measures.
Article 14 (Closing Your Account)
1. You can close your account at any time from within the App.
2. When you close your account, your information stored on our servers is deleted as set out in the Privacy Policy, and cannot be restored.
3. Closing your account does not cancel a subscription purchased on the App Store. Please cancel it yourself in the way Apple Inc. provides.
Article 15 (Disclaimer of Warranties and Limitation of Liability)
1. We do not guarantee that the App is fit for any particular purpose of yours, that it has the functions, accuracy or usefulness you expect, or that it is free of faults.
2. The forecasts and advice from the App's AI features, and its graphs, are for reference only, and do not guarantee any training result or health benefit.
3. The App is not a medical device, and is not intended to diagnose, treat or prevent any disease. You train at your own responsibility, taking your own physical condition into account. If you have concerns about your health, please consult a doctor or another professional.
4. If a dispute arises between users, or between you and a third party, you resolve it at your own responsibility and cost.
5. For damage you suffer in connection with the App, except where we act intentionally or with gross negligence, we are liable only for direct and ordinary damage, up to the greater of the amount you paid for subscriptions to the App in the 12 months before the day the damage arose and 10,000 yen. This does not apply where the law does not allow liability to be limited (including damage to your life or body caused by our negligence).
Article 16 (Changes to These Terms)
1. We may change these Terms without your consent, under Article 548-4 of the Civil Code of Japan, if either of the following applies.
- (1) The change is in the general interest of users
- (2) The change does not conflict with the purpose of these Terms, and is reasonable in light of the need for it, the appropriateness of the changed content and other circumstances of the change
2. When we change these Terms under the preceding paragraph, we will announce in the App or on our website, 30 days before the change takes effect, that we are changing these Terms, what the changed Terms say, and when they take effect. This announcement is addressed to all users, including users with a subscription.
3. If you do not agree to the changed Terms, you may stop using the App and close your account under Article 14 before the change takes effect. In that case, please cancel any subscription purchased on the App Store yourself, as set out in paragraph 3 of that Article.
Article 17 (Notices)
We give notices to you by posting them in the App or on our website, or by any other method we consider appropriate.
Article 18 (Transfer)
1. You may not transfer your position or rights and obligations under these Terms to a third party, or offer them as security.
2. If we transfer the business of the App to a third party, we may transfer to that party our position and rights and obligations under these Terms and your information, and you agree to this in advance.
Article 19 (Severability)
Even if any provision of these Terms, or part of one, is held invalid or unenforceable under the Consumer Contract Act or any other law, the remaining provisions continue in effect.
Article 20 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan. Any dispute between us and you concerning the App or these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
